Congress has not passed climate change legislation, and passage in the near term seems unlikely. EPA, however, has moved ahead with issuing regulations governing greenhouse gas regulations under the federal Clean Air Act. EPA plans to implement those regulations in states that are unable or unwilling to implement them under their delegated Clean Air Act programs. The largest emitter of greenhouse gases, the State of Texas, has sent a letter to EPA refusing to implement greenhouse gas emission regulations.
