On August 29, 2008, the Texas Supreme Court issued three significant insurance decisions concerning trigger, “bodily injury” and whether coverage can be expanded by waiver or estoppel. In DON’S BUILDING SUPPLY, INC., V. ONEBEACON INS. CO, ZURICH AMERICAN INS. CO. ET AL V. NOKIA AND RELATED CASES, AND ULICO CAS. CO. V. APA, the Court grappled with a number of hot emerging issues, such as:
What is the appropriate trigger for 'property damage'? Manifestation? Exposure? Injury in fact?
Does alleged “biological injury” constitute “bodily injury” and trigger the duty to defend? Manifestation? Exposure? Injury in fact?Does the Wilkinson exception to the general rule that you cannot create coverage by estoppel still apply?
What do these opinions say about the direction that the Texas Supreme Court is taking in deciding insurance cases?
